Customer Terms of Service

These Customer Terms of Service ("Terms") govern your use of the services provided by Amplifiles, a service operated by Aava AI Oy (Aava AI Ltd.) ("Company," "we," "our," or "us"). By accessing or using our services, you agree to comply with and be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using the services provided by Amplifiles, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our services.
2. Description of Services
Amplifiles provides an innovative platform that transforms static images and written text into dynamic, engaging experiences. Our services include automated script generation, image to video conversion, hosting and analytics, interactive elements, and easy sharing functionalities.
3. Use of Services
You agree to use Amplifiles services solely for lawful purposes and in accordance with these Terms. You are responsible for maintaining the security of your account and any activities that occur under your account.
4. Responsibility for Uploaded and Generated Content
4.1 Ownership of User Content
Unless otherwise agreed in writing, you retain ownership of any content you upload to the Services, including but not limited to photographs, videos, audio, text, brand assets, and other materials (“User Content”). Amplifiles does not claim ownership of your original User Content.
4.2 License to Amplifiles
By uploading User Content to the Services and using the Services to generate videos or other materials, you grant Amplifiles a perpetual, non exclusive, royalty free, worldwide license to use, reproduce, display, distribute, and showcase any videos or materials generated through the Services for Amplifiles’ own marketing, promotional, sales, product demonstration, and investor related purposes. This may include, without limitation, use on Amplifiles’ website, social media channels, presentations, and marketing materials.
This license is granted without any obligation of compensation, attribution, or approval and remains in effect even if you stop using the Services.
4.3 Responsibility for User Content
You are solely responsible for all User Content that you upload, generate, publish, or otherwise use through the Services. You represent and warrant that you hold all necessary rights, licenses, consents, and permissions to upload and use such User Content and to grant the rights set forth in these Terms.
You agree that your use of the Services and any resulting content will comply with all applicable laws and regulations, including intellectual property, copyright, trademark, advertising, and consumer protection laws.
Amplifiles does not monitor, review, or verify the legal status, accuracy, or compliance of User Content or generated materials.
4.4 AI Generated Content and Accuracy
The Services may use artificial intelligence and automated systems to generate or modify content, including but not limited to videos, text, scripts, animations, visual enhancements, or recommendations (“AI Generated Content”). AI Generated Content is produced automatically and may contain inaccuracies, omissions, unintended representations, or results that do not reflect real world conditions.
Amplifiles does not guarantee the accuracy, completeness, or suitability of any AI Generated Content for any particular purpose, including marketing, advertising, or regulatory compliance. You acknowledge and agree that you are solely responsible for reviewing, validating, and approving all AI Generated Content before publishing, distributing, or otherwise using it.
You agree not to rely on AI Generated Content as a sole source of truth and acknowledge that all use of such content is at your own risk.
4.5 False Advertising and Compliance
You are solely responsible for ensuring that any content created or distributed using the Services does not contain false, misleading, or deceptive statements and complies with all applicable advertising and consumer protection laws. Amplifiles shall not be liable for any claims related to false advertising, misrepresentation, or inaccurate marketing materials created using the Services.
4.6 Indemnification
You agree to indemnify, defend, and hold harmless Amplifiles, its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys fees, arising out of or related to:
- your User Content or AI Generated Content
- any allegation that your content infringes or violates the rights of a third party
- any claim related to false advertising, misrepresentation, or regulatory non compliance
- your breach of these Terms or misuse of the Services
5. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information.
6. Intellectual Property
All content and materials provided by Amplifiles, including but not limited to logos, designs, text, graphics, software, and other files, are the property of Amplifiles or its licensors. You may not use, reproduce, modify, distribute, or transmit any such content without our prior written consent.
7. Billing and Payments
(a) Subscriptions and One Off Purchases
To access and use certain Services, you may be required to enroll in a subscription payment plan (a “Recurring Subscription”) or make a one off purchase. Recurring Subscriptions automatically renew until you cancel them or they are otherwise terminated. One off purchases are charged at the time of purchase and do not renew automatically unless explicitly stated at checkout.
You authorize Amplifiles to store your payment method information and to automatically charge your payment method(s) for all amounts due in connection with your use of the Services, including Recurring Subscriptions, one off purchases, usage based fees, and applicable taxes, with no further action required by you.
The length and applicable pricing of any Recurring Subscription or one off purchase will be provided when you make your purchase.
In the event that Amplifiles is unable to charge your payment method(s) as authorized, Amplifiles may in its sole discretion (i) suspend your access to the Services until payment is received or (ii) seek to update your payment method information through third party sources, such as your bank or a payment processor, to continue charging your payment method as authorized.
You may cancel a Recurring Subscription through your account at any time. If you cancel a Recurring Subscription before the end of the current subscription period, subscription fees already paid will not be refunded. Following cancellation, you will continue to have access to the applicable Services through the end of your current subscription period. One off purchases are not cancellable and are non refundable unless otherwise stated.
Amplifiles may change the prices charged for Recurring Subscriptions or one off purchases at any time by posting updated pricing through the Services. Prices for an active Recurring Subscription will remain in force for the duration of the subscription period for which you have paid. After that period ends, continued use of the Services will be charged at the then current price. If you do not agree to a price change, you must cancel your Recurring Subscription at least 7 days before the change takes effect. If you do not cancel, your Recurring Subscription will automatically renew at the then current price and for the same duration as the initial subscription term, and Amplifiles will charge your on file payment method on the first day of the renewal term.
(b) Usage Based and Overage Charges
Certain Services may include usage limits. If your usage exceeds the volume included in your Recurring Subscription or one off purchase, you will be charged additional usage or overage fees as indicated at the time of purchase. You authorize Amplifiles to charge your payment method on file for such charges.
(c) Payment Authorization
You represent and warrant that you have the right to use any payment method submitted in connection with a payment. Amplifiles may receive updated payment method information from your issuing bank or payment service provider. You authorize Amplifiles to charge your payment method, including any updated payment method information, for all charges incurred under these Terms.
Verification of information may be required prior to the completion of any transaction. You agree to pay all charges incurred by you or on your behalf through the Services at the prices in effect at the time the charges are incurred, including applicable taxes where required by law, as well as any shipping and handling charges related to your transactions.
In the event legal action is required to collect amounts due, you agree to reimburse Amplifiles and its vendors or agents for all reasonable costs incurred, including attorneys fees and other legal expenses.
(d) Refunds and Exchanges
All sales are final unless otherwise stated. Amplifiles may offer refunds or credits at its sole discretion.
(e) Reservation of Rights
Amplifiles reserves the right, without prior notice, to impose conditions on the honoring of any coupon, discount, or promotion, to bar any user from completing a transaction, to alter available payment options, and to refuse to provide any Service.
(f) Credits and Expiration
Certain Services may be provided on a credit based basis. Purchased, granted, or allocated credits are valid for a period of twelve months from the date they are issued unless otherwise stated at the time of purchase. Credits expire automatically after the applicable validity period and have no monetary value. Expired credits cannot be refunded, reinstated, or exchanged. Credits are non transferable and may only be used in connection with the account for which they were issued.
(g) Taxes
Amplifiles provides Services globally. Prices displayed through the Services may be exclusive of applicable taxes unless otherwise stated. You are responsible for paying any applicable sales, use, value added tax, goods and services tax, withholding taxes, or similar governmental charges imposed by your jurisdiction, except where Amplifiles is legally required to collect and remit such taxes on your behalf. Where required by law, Amplifiles will collect and remit applicable taxes and such taxes will be shown at checkout or on your invoice.
8. Cancellation and Termination
You may cancel a Recurring Subscription at any time through your account settings or as otherwise described in the Services. Cancellation of a Recurring Subscription will take effect at the end of the then current billing period. Following cancellation, you may retain access to your Amplifiles account, but access to subscription based features or Services may be limited or disabled.
Termination of a subscription does not terminate your account unless explicitly stated. Any remaining credits will continue to be governed by Section 7(f), including applicable expiration periods.
Amplifiles may suspend or terminate your account, access to the Services, or any licenses granted to you at any time if you breach these Terms, fail to pay applicable fees, or use the Services in a manner that may cause legal risk or harm to Amplifiles or others. Amplifiles may attempt to notify you prior to suspension or termination, but is not obligated to do so.
Upon termination of your account for any reason, your right to access and use the Services and any licenses granted under these Terms will immediately cease.
9. Limitation of Liability
In no event shall Amplifiles be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services.
10. Changes to Terms
We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of our services after any such changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles.
12. Dispute Resolution
Disputes arising from or in connection with the Agreement will be first and foremost solved by negotiations between the parties. If no satisfactory conclusion for both parties is reached within 60 days of the commencement of the negotiations, the matter shall be solved in Finland, at the District Court of Pirkanmaa as a first instance.
13. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
